CTA Hypocrisy Exposed by Vergara Ruling

The California Teachers Association is the most powerful special interest in California. They often run ads touting how much they care about education and our students, while at the same time steadfastly defending laws that make it virtually impossible to fire grossly ineffective teachers who can have a devastating impact on the education of students. Yesterday a judge in Los Angeles exposed this hypocrisy by ruling that CTA-backed laws protecting ineffective teachers are illegal because they deprive our children of a quality education.

The judge found:

“Evidence has been elicited in this trial of the specific effect of grossly ineffective teachers on students. The evidence is compelling. Teachers can receive a $300 – $400 ‘rebate’ for CTA’s political spending

Although California is not a right-to-work state, public school teachers have the ability to receive a yearly rebate of $300 – $400 from the California Teachers Association.

Teachers have these options because the United States Supreme Court has held that a union can’t force a non-union member to pay for the union’s political and other activities unrelated to bargaining and representing workers.

A teacher’s ability to exercise these options is limited, however, and the necessary paperwork must be sent to CTA by November 15. Reforming Public Sector Unions and Public Sector Pensions is NOT “Anti-Worker”

An incoming email responding to last week’s commentary, “Los Angeles Police Union Attacks Messenger Rather Than Confront Pension Crisis” included the following statement:

“While you profess not to dislike public employees, it is clear that you disliking public employee unions. Interesting—so you might like a public employee or two individually, you just dislike when those individuals organize to work for better working conditions or pay. Which goes hat in hand with your desire to make public employee pension plans seem so expensive that they are terminated.”

This invites a response.

Our concerns about public employee unions are primarily based on the fundamental differences between unions in the public sector vs. unions in the private sector. There’s nothing wrong – in principle – when “individuals organize to work for better working conditions or pay.” But if those individuals work for the government, there are plenty of problems.
