Jessica Arciniega: From “Union Agent” to ALRB Attorney

In 2003, an Agricultural Labor Relations Board administrative judge identified Jessica Arciniega as “UFW staff member” at its Oxnard office. ALRB administrative law judge Nancy Smith even called her a “union agent.”

Today, Arciniega is one of the ALRB’s top staff attorneys. And with the recent shakeups in the ALRB general counsel’s office that resulted in the sackings and sudden resignations of top lawyers, people are wondering why Arciniega remains on the job.

The lawyer has come a long way since getting her law degree as an “apprentice” of longtime UFW lawyer Barbara Macri-Ortiz, who in fact calls Arciniega “my apprentice.”

State law requires all ALRB personnel to be worker advocates with no partiality for or against either employers or unions. Arciniega is anything but objective. Her title at the UFW was “lead organizer.” The Militant, published by the Socialist Workers Party, reports Arciniega being a UFW boycott leader as far back as 2000.

In Oxnard more than a decade ago, the Los Angeles Times profiled Arciniega under the headline, “… Read More

Plenty of Evidence of Injustice to Farm Workers By California Govt.

With the dozens of stories I’ve written about the bold fight of farm workers at Gerawan Farming against unionization by the United Farm Workers labor union, and the Agricultural Labor Relations Board, a couple of recent letters synopsized the shocking series of events.

The attorney for the workers, Paul Bauer, penned two letters to ALRB Regional Director Silas Shawver, outlining events, and laying out a clear case for conflicts of interest by the attorneys at the ALRB.

I’ve reported on the Gerawan workers since Spring 2013, including the November 5, 2013 decertification election. Because the Gerawan workers likely voted to decertify the UFW, Shawver and Sylvia Torres Guillen, both attorneys with the ALRB, locked up the ballots and refused to count them, claiming there was some interference with the… Read More

The Sordid Story of the Radicals at the CA Ag Labor Board

The California Agricultural Labor Relations Board may have just celebrated its 40th anniversary, but this board also has a long history of abusive behavior – toward California farm workers, and farmers and ranchers.

Many are aware of the fight that thousands of workers at Gerawan Farming have been waging since 2012 to oust the United Farm Workers union from Gerawan. The ALRB has clearly been “in cahoots” with the UFW, according to a Superior Court Judge, to force the workers into the union.

But there are many more cases of farm and ranch owners abused by the ALRB, which raise serious doubts about the fairness and objectivity of this California state agency created to defend the rights of farmworkers. And top ALRB attorneys are involved up to their eyeballs, misleading farm workers, as well as the courts.

Some of the obscure cases resurfaced after the surprise gubernatorial appointment last week of Sylvia Torres-Guillen, the controversial general counsel of the state Agricultural Labor Relations Board, to Gov. Jerry Brown’s office as special counsel. Many say Brown did this to avoid any more public scrutiny over his appointment of… Read More

“In Cahoots” – The Illegal Relationship Between ALRB Lawyers and the UFW

One of the most significant labor relations fights in the country is currently taking place in California’s Central Valley. The California state agency mandated by law to be an impartial farmworkers’ advocate between employers and unions is “in cahoots” with the United Farm Workers labor union. At issue are the legal tactics and scruples of the California Agricultural Labor Relations Board.

A state superior court judge told an Agricultural Labor Relations Board attorney in 2013 that it appeared they were “in cahoots” with the United Farm Workers labor union. Even an independent investigation has confirmed that this is so.

Since being appointed ALRB General Counsel in 2011 by Gov. Jerry… Read More

Cover Up? Brown’s Legislative Aide Linked to ACORN’s Successor

A Governor’s appointee with upwards of 40 violations of the Fair Political Practices Act works right in Jerry Brown’s office, and somehow has managed to retain her job while demonstrating an uncanny talent for avoiding major media’s spotlights.

While Deputy Legislative Secretary Martha Guzman-Aceves has served as a public official in the Brown Administration managing legislation and regulatory matters for the governor, her non-profit organization lobbied the Legislature and governor’s office on various issues, including AB1081, federal immigration policy enforcement,” I reported in October 2013.

“California Deputy Legislative Secretary Martha Guzman-Aceves intentionally filed false documents with the Fair Political Practices Commission (FPPC) to conceal hundreds of thousands of dollars, filed false tax returns, failed to report receipt of payment from a political committee, and omitted third-party relationships that directly conflict with her position and duties as Deputy Legislative Secretary in the Office of Governor Jerry Brown,” the… Read More

Do union activists work for Gov. Brown, farm board?

SACRAMENTO — The revolving door among political consultants, community organizers and state government revolves right into the governor’s office and the Agriculture Labor Relations Board.

In 2011, Gov. Jerry Brown appointed Martha Guzman-Aceves deputy legislative secretary for agriculture, environment and natural resources. Before that, she was a founding partner of Cultivo Consulting, which says it engages in lobbying, political campaigning and community organizing in California. It’s a lobbying and outreach firm specializing in social, economic and environmental justice.

She also was listed on 2011 tax returns (pictured nearby) as… Read More
