Calling all lawyers!

While it’s clear McCain has won California – and surged to a fairly commanding lead in the delegate count nationally, several California Congressional District Presidential Delegations are still up in the air.  And with delegates at stake, I wouldn’t be surprised if election lawyers start descending on our ROV’s across the state to monitor final counts.

Having lived through many close elections (I have a t-shirt that reads “6 F-ing votes!” to commemorate one memorable win), I think its safe to advise Presidential Delegates in a number of districts not to pack their bags or cancel their flights just yet.

With Debbie “let them use paper” Bowen’s push back to paper ballots, the large turnout, and the early primary, there are still many votes left to be counted.

Here are just a few samples where it’s probably just too close to call:

CA-03 (Sacramento County)
*John McCain 22,028     39.06
Mitt Romney 22,001     39.01
-26 vote difference with hundred’s of late AB and provisional ballots left to count (including my wife’s!)

There are a number of others that are close, too:

CA-21 (Fresno/Tulare Counties)
John McCain 18,261    35.7
*Mitt Romney  18,477    36.1
-216 vote difference

CA-25 (LA/San Bernardino/Inyo/Mono Counties)
*John McCain 21,541    39.1
Mitt Romney  20,270    36.8
– 1271 vote difference

CA-42 (LA/Orange/San Bernardino Counties)
*John McCain 26,836    38.5
Mitt Romney 26,672    38.2
– 191 vote difference

CA-48 (Orange County)
*John McCain 34,611    39.5
Mitt Romney 34,033    38.9
– 578 vote difference

CA-49 (San Diego/Riverside Counties)
John McCain 22,546    37.9
*Mitt Romney 22,763    38.3
– 217 vote difference

CA-50 (San Diego County)
*John McCain 31,195    40.9
Mitt Romney 30,062    39.4
– 1133 vote difference

* marks the current leader

    To reinforce Tad’s point about the counting continues: turnout is currently only at 45.4%. That is almost certain to climb to 50% and probably significantly higher as ballots are counted. That’s a LOT of ballots still sitting out there.

    Update from CD 42 (Chino Hills, Diamond Bar, Yorba Linda)

    * Mitt Romney 29,589 38.3 %
    John McCain 29,516 38.3 %

    73 Votes Difference…WHEW!
