True Conservatives Won’t Squash the “Amazon Tax” Referendum

My good friend Rex Hime recently penned a column for the Flash Report citing several instances where conservatives in other states supported “e-fairness” legislation.

That’s an interesting debate for another day. The issue before us today is not about the “Amazon Tax” itself—that bill already passed the Legislature this summer with only one Republican vote.

The issue before us is whether or not Republican lawmakers should support Assembly Bill 155—a blatant attempt by Democrats to block California voters from holding a referendum on the “Amazon Tax.” By cementing this failed policy into law with a 2/3rds vote of the Legislature, California voters would be denied the opportunity to overturn the “Amazon Tax.”

AB 155 is a slap in the face to the nearly one million California voters who have already signed petitions calling for a referendum of the “Amazon Tax.”

Tax Increases Fuel Job Growth?

I have a question. I mean this in all sincerity. I ask it without intending a drop of cynicism. My question is this: How do tax increases create jobs?

The question is prompted by the governor’s news conference on August 25. It is no secret that California has a serious jobs problem. Our unemployment rate is the second highest in the nation, and that understates the problem as our jobless rate does not include (1) those who have given up searching for jobs, and (2) those who are underemployed and seek full time work but cannot find it because of our anemic economy. Persistent joblessness destroys our economy, our communities, and our families. For that reason, the governor and Democrat leadership have promised to focus on the jobs problem in the last two week of the legislative session.

It is about darn time. The GOP months and months ago proposed dozens of pro-jobs and pro-economic growth bills. But, as I detailed in my last column, the Democrats killed all of those bills. And now they want to focus on jobs? Welcome to the issue, guys. Better late than never.

It’s not every day a government program becomes less burdensome for small business owners and entrepreneurs, but it can happen.

A Temporary Tax That Never Went Away

California taxpayers are celebrating a rare victory. Despite Democrat efforts to extend them, the sweeping “temporary” tax increases of 2009 have gone away. This is an uncommon treat, as many prior tax hikes sold as “temporary” are still with us today.

As Californians enjoy the benefits of this victory, today marks the 20th anniversary of a prior sales tax increase that is still with us. On July 15, 1991 Californians were impaled with a “temporary” sales tax increase of 1.25%. This measure was enacted by the Legislature to address the state budget shortfall during the early 1990s economic downturn.

Fast forward to June of this year. A 2009 sales tax rate increase of 1% was set to expire on July 1, 2011. Despite a vote of the people against extending this and other temporary tax increases, Governor Jerry Brown and Democrat legislators unsuccessfully sought a five year extension of these taxes.

These higher taxes amounted to billions of dollars per year out of the pockets of struggling Californians and into the hands of wasteful government. Combine the 2009 temporary sales tax increase with the 1991 temporary sales tax increase, and… Read More

Let the People Decide Amazon Tax

Democrat lawmakers are protesting a proposed referendum on California’s new “Amazon Tax” law. But keep in mind that this issue isn’t about Amazon. It’s about the thousands of California jobs the “Amazon Tax” places in jeopardy.

The lawmakers who authored the ‘Amazon Tax’ should be ashamed to appear in public. Their law has failed to achieve their goals. Instead it is punishing thousands of California small business affiliates who are losing income and may even be forced to leave the state.

The Legislature should admit its mistake and repeal the Amazon Tax. But short of that, the fastest way to save California jobs is through a referendum rather than years of costly litigation. Let the people engage in the debate and decide the issue for themselves.… Read More

Qualified Purchasers Survey

The “Qualified Purchasers Program” was created by the State Legislature, when it approved Assembly Bill X4 18 in 2009. I was serving as a Senator at the time and voted against the legislation. I continue to believe this new use tax collection program is a costly mistake.

To date BOE has identified more than 500,000 businesses as “qualified purchasers” and has automatically registered many of them with a “use tax” account. A qualified purchaser is defined as a service enterprise with more than $100,000 in gross receipts per calendar year that is not already registered with the Board of Equalization.

Most people are understandably confused about ‘use tax.’” The use tax applies to all Californians when you purchase items from a retailer who is not located in California and not registered to remit tax to California. Prior to the creation of the Qualified Purchaser Program, there were already two different ways for Californians to report use tax—(1) BOE Form 79b and (2) a dedicated line on state income tax forms.

Jerry Brown Signs Away Affiliate Jobs

Even as Governor Jerry Brown lifted his pen today to sign the so-called “Amazon Tax” into law, thousands of affiliates across California were losing their jobs.

Major out-of-state retailers like Amazon.com and Overstock.com are terminating their California affiliate advertising programs in response to this legislation. I’ve been warning for months that this would happen, but apparently these warnings fell on deaf ears.
